Terms of Service

The Dirt Brief

These Terms of Service (“Terms”) govern your access to and use of The Dirt Brief, a trip planning and coordination platform operated by Rimrock Labs LLC, a Utah limited liability company (“Rimrock Labs,” “we,” “us,” or “our”). By accessing or using our website at thedirtbrief.com or any related services (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

The Service is currently in beta. This means features may change, data may be lost, and the product may experience downtime or errors. By participating in the beta, you acknowledge and accept these risks.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Account Registration

To access certain features of the Service, you may be required to create an account. You agree to provide accurate and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Beta Program

The Service is currently offered as a beta release. As a beta participant, you understand and agree that:

  • The Service is provided on an “as-is” and “as-available” basis without warranties of any kind.
  • Features, functionality, and user interface elements may change significantly or be removed entirely at any time without notice.
  • Data you enter into the Service, including trip plans, routes, GPS tracks, and other content, may be lost due to bugs, system failures, or product changes. You are responsible for maintaining your own backups of any important data.
  • We may discontinue the beta program or the Service entirely at any time without notice or liability.
  • Your participation in the beta does not guarantee continued access to the Service after the beta period ends.

4. Acceptable Use

You agree to use the Service only for its intended purpose of planning and coordinating trips and group activities. You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload, share, or transmit any content that is defamatory, obscene, abusive, threatening, or otherwise objectionable.
  • Attempt to gain unauthorized access to the Service, other user accounts, or any systems or networks connected to the Service.
  • Use any automated means (bots, scrapers, crawlers) to access the Service or extract data from it.
  • Reverse engineer, decompile, or disassemble any portion of the Service.
  • Use the Service to send spam or unsolicited communications.
  • Interfere with or disrupt the Service or the servers or networks providing the Service.

5. User Content

The Service allows you to create, upload, and share content including trip plans, routes, GPS tracks, descriptions, photos, and other materials (“User Content”). You retain ownership of your User Content. By submitting User Content to the Service, you grant Rimrock Labs a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You represent and warrant that you own or have the necessary rights to submit your User Content and that your User Content does not infringe the intellectual property rights or other rights of any third party.

We do not endorse or guarantee the accuracy, completeness, or reliability of any User Content. You acknowledge that you may be exposed to User Content that is inaccurate or misleading.

Organizer Responsibilities. If you use the Service as a trip organizer to add participants by name, email, or other identifying information, you represent and warrant that you have the authority to share that information with the Service. You are responsible for informing those participants that their information has been added to the Service and for directing them to these Terms and our Privacy Policy.

6. Intellectual Property

The Service, including its design, features, functionality, code, and documentation, is owned by Rimrock Labs and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to use the Rimrock Labs or The Dirt Brief names, logos, or trademarks.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

7. Outdoor Activities & Assumption of Risk

The Service is a trip planning and coordination tool. It is not a safety guide, navigation system, or substitute for proper outdoor skills, experience, or professional guide services. You acknowledge and agree that:

  • Trail, route, road, and weather conditions change frequently and without warning. Information displayed through the Service may be outdated, inaccurate, or incomplete. You must independently verify all conditions with local authorities, land managers, and current sources before undertaking any outdoor activity.
  • The Service does not assess your fitness, skill level, or preparedness for any activity. You are solely responsible for determining whether you are adequately prepared, equipped, and experienced for any trip or activity planned using the Service.
  • Outdoor activities including but not limited to overlanding, hiking, camping, off-roading, and backcountry travel involve inherent risks of serious injury or death. You voluntarily assume all risks associated with any outdoor activities planned, coordinated, or discussed using the Service.
  • GPS tracks, waypoints, routes, and maps provided through the Service are for general reference only and should not be relied upon as your sole means of navigation.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Rimrock Labs does not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Service or the servers providing the Service are free of viruses or other harmful components.

The Service provides trip planning tools and information for general reference only. Rimrock Labs is not responsible for the accuracy of any route, trail, road, or geographic information displayed through the Service. You are solely responsible for verifying all trip information, assessing conditions, and making safe decisions during any trip or activity.

9. Limitation of Liability

To the maximum extent permitted by law, Rimrock Labs and its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the theory of liability.

Rimrock Labs shall not be liable for any personal injury, property damage, or death arising from your use of information obtained through the Service, including but not limited to trip plans, routes, trail conditions, or geographic data.

In no event shall Rimrock Labs’ total liability to you exceed the greater of (a) the amounts you have paid to Rimrock Labs in the twelve months preceding the claim, or (b) one hundred dollars ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless Rimrock Labs and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections 5 through 14 of these Terms shall survive any termination.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices regarding your personal data.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the “Effective Date” above. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

14. General Provisions

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

Dispute Resolution. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah. You consent to the personal jurisdiction of such courts.

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Rimrock Labs regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Waiver. The failure of Rimrock Labs to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms or your rights under these Terms without the prior written consent of Rimrock Labs. Rimrock Labs may assign these Terms without restriction.
